1. About These Terms

These Terms of Service apply to the use of the Modern Viking website and to purchases made from Modern Viking Pty Ltd.

By placing an order, creating an account or using the website, you agree to the terms that apply at that time.

Our Privacy Policy, Shipping Policy, Refund and Returns Policy and Product Safety, Age and Legal Restrictions Policy also apply where relevant.

2. Australian Consumer Law

Our products and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified.

If any part of these Terms is inconsistent with a mandatory right under applicable law, that mandatory right will prevail.

3. Website Use

You may use the website only for lawful purposes.

You must not:

• Use the website in a fraudulent, unlawful or harmful manner.
• Attempt to gain unauthorised access to the website, customer accounts or systems.
• Introduce malicious software, automated attacks or disruptive code.
• Copy or commercially exploit website content without permission.
• Use Modern Viking products for unlawful, violent, threatening or prohibited purposes.

We may restrict website access where reasonably necessary to protect customers, the business or the security of the website.

4. Product Information

We aim to provide accurate product descriptions, photographs, prices, availability information and specifications.

Product photographs may be affected by lighting, screens and photography conditions.

Product pages may also contain representative photographs where products are handmade or made from natural materials.

Any material product characteristics, intended-use restrictions, age restrictions, care requirements and approximate specifications should be reviewed before ordering.

Where an error is identified before an order is accepted or produced, we may contact the customer to correct the information, offer an alternative or cancel and refund the affected item.

Nothing in this section permits Modern Viking to supply a product that materially differs from its description or representative examples in breach of applicable consumer law.

5. Natural and Handcrafted Products

Some products are individually made from natural materials including buffalo horn, timber and leather.

Natural differences may include:

• Colour and shade
• Grain and markings
• Texture and pattern
• Curvature and shape
• Exact dimensions
• Minor differences in carving placement, depth and finish

No two natural-material products will look exactly the same.

Where these characteristics are clearly disclosed, the disclosed differences are not, by themselves, product faults, provided the product remains within its advertised approximate specifications and matches the ordered material, carved design, intended function and personalisation.

Natural variation does not excuse faults such as cracks, leaks, unsafe edges, damaged coatings, unacceptable workmanship, the wrong design, incorrect personalisation or a product materially outside its advertised specifications.

6. Orders and Acceptance

Submitting an order is an offer to purchase the selected products.

An automated order confirmation acknowledges that we have received the order but does not necessarily confirm that every part of the order has been accepted.

We may accept an order by:

• Beginning engraving, personalisation or custom production
• Confirming acceptance separately
• Dispatching the order

We may reasonably refuse or cancel an order before acceptance where:

• A product is unavailable
• Payment has not been authorised
• Fraud or unauthorised payment is reasonably suspected
• Required age or identity verification cannot be completed
• The product cannot lawfully or safely be shipped to the destination
• A material and obvious pricing or product-information error has occurred
• A carrier will not accept the product
• Fulfilling the order would breach an applicable law

Where we cancel an order, we will refund amounts paid for products or services that will not be supplied.

We will not cancel an accepted order merely because we later decide that the agreed price was commercially disadvantageous.

7. Prices, Payments and Promotions

Prices are displayed in Australian dollars unless stated otherwise.

Australian prices include GST where applicable.

Available payment methods are shown during checkout.

Prices and promotional offers may change for future orders.

Any price, discount, gift or promotional shipping benefit successfully applied to an accepted order will be honoured subject to the clearly disclosed terms of that promotion.

Promotional qualifications and material exclusions must be read together with the main offer.

We may correct an obvious pricing error before accepting an order. Where this occurs, we will contact the customer and offer the choice of proceeding at the correct price or cancelling the affected item for a refund.

8. Personalised and Custom Products

Customers must carefully check all personalisation details before submitting an order, including:

• Names and initials
• Dates
• Symbols
• Spelling
• Punctuation
• Capitalisation

We produce the personalisation using the details submitted or confirmed with the order.

Once engraving, personalisation or custom production has begun:

• The personalisation cannot be changed.
• The order cannot be cancelled for change of mind.
• The personalised product cannot be returned for change of mind.

An error in details submitted or approved by the customer is not considered a product fault where the finished personalisation matches those instructions.

This does not exclude rights where Modern Viking makes the engraving error, supplies the wrong design or the underlying product is faulty, unsafe, damaged or materially different from its description.

Customers must not submit personalisation that:

• Is unlawful or threatening
• Infringes another person’s intellectual property
• Promotes criminal or violent conduct
• Modern Viking reasonably considers inappropriate to produce

We may decline that personalisation and provide an appropriate cancellation or alternative before production begins.

9. Age-Restricted and Bladed Products

Modern Viking requires purchasers of knives, swords, axes and any other product identified as age restricted to be at least 18 years old.

We may request valid age or identity verification before production or dispatch.

An age declaration made during checkout does not prevent us from requesting additional verification.

We may cancel and refund an order where:

• The purchaser cannot complete the required verification
• The purchaser is under 18
• The product cannot lawfully or safely be supplied to the destination
• The available carrier will not accept the shipment

Customers must check any laws applying to possession, importation, transport and use in their destination.

Modern Viking will also take reasonable steps not to knowingly complete a sale or shipment that would breach an applicable restriction.

10. Product Purpose and Safety

Products must be used only for the intended purpose stated on the relevant product page.

A collector or display item must not be used as a functional tool or weapon.

A culinary product must be used, maintained and stored as culinary equipment.

An outdoor tool must be used only for its stated outdoor or utility purpose.

Bladed products can cause serious injury if mishandled. Customers must follow all supplied warnings, care instructions and safe-storage requirements.

Products must be kept securely stored and away from children and unauthorised users.

Modern Viking is not responsible to the extent that loss or damage was caused by:

• Unlawful or deliberate misuse
• Use outside the clearly stated purpose
• Failure to follow supplied safety or care instructions
• Unauthorised alterations
• Improper storage or maintenance
• Continued use after the product became visibly damaged or unsafe

This section does not exclude liability for a safety defect, product fault, negligence or other matter where liability cannot lawfully be excluded.

11. Shipping and Preorders

Shipping, processing, delivery, preorder and customs terms are explained in our Shipping Policy.

Product-specific processing or estimated dispatch information displayed at the time of purchase forms part of the relevant order information.

Preorder dates are estimates based on information available at the time.

If a material delay occurs, we will provide updated information and handle any cancellation or refund request according to our Shipping Policy, Refund and Returns Policy and applicable law.

12. Returns, Refunds and Warranties

Returns, refunds, damaged deliveries, personalised-product exclusions and natural-material variation are governed by our Refund and Returns Policy.

Any voluntary Modern Viking warranty is provided in addition to, and does not replace or limit, rights under the Australian Consumer Law.

Product-specific warranty coverage applies only where clearly stated on the relevant product page or in the warranty terms supplied with the product.

13. Customer Accounts

Customers are responsible for keeping account credentials secure and for providing accurate account and contact information.

Contact us promptly if you reasonably suspect unauthorised access.

We may suspend an account where reasonably necessary to investigate fraud, security risks or serious breaches of these Terms.

Account suspension does not remove obligations relating to orders already accepted or consumer rights relating to completed purchases.

14. Intellectual Property

Website content, branding, photographs, graphics, text and original product artwork are owned by or licensed to Modern Viking.

You may view and share website content for ordinary personal and non-commercial purposes.

You must not reproduce, sell, commercially exploit, remove branding from or claim ownership of Modern Viking content without permission.

Nothing in these Terms claims ownership of intellectual property lawfully belonging to another person.

15. Reviews and Customer Content

Where customers submit reviews, photographs or other content, they confirm that:

• The content is based on their genuine experience.
• They have the right to submit it.
• It does not unlawfully infringe another person’s rights.
• It is not knowingly false, threatening or defamatory.

Customers grant Modern Viking permission to display and reproduce submitted content for website, customer-service and marketing purposes unless otherwise agreed.

We may remove content where reasonably necessary for legal, safety, privacy or moderation reasons.

We will not remove or suppress a genuine negative review merely because it is unfavourable.

16. Third-Party Services and Links

The website may use third-party payment, shipping, analytics, communication and technology providers.

Third-party websites that Modern Viking does not control may have their own terms and privacy practices.

Modern Viking is not responsible for independent third-party website content merely because a link is provided.

This section does not remove Modern Viking’s responsibilities for payment, shipping or other service providers engaged by Modern Viking to fulfil a customer’s order.

17. Website Availability

We aim to keep the website secure and available but cannot guarantee uninterrupted access at all times.

We may temporarily suspend access for maintenance, security, technical problems or events outside reasonable control.

Website interruption does not remove obligations relating to accepted orders or applicable consumer rights.

18. Changes to These Terms

We may update these Terms for legal, operational, security or business reasons.

Updated Terms apply to future website use and orders from the effective date shown.

A change will not retrospectively remove a right or materially alter an order already accepted unless:

• The customer agrees; or
• The change is required by law.

Material changes may be communicated through the website or other appropriate means.

19. Governing Law

These Terms are governed by the laws applying in New South Wales and Australia.

Nothing in these Terms prevents a consumer from relying on mandatory rights or bringing a claim in a court, tribunal or jurisdiction available under applicable law.

The parties may attempt to resolve a dispute directly before commencing formal proceedings, but mediation or arbitration is not mandatory unless separately agreed after the dispute arises.

20. Severability

If a court determines that any part of these Terms is invalid, unlawful or unenforceable, that part will be treated as removed or limited to the minimum extent necessary.

The remaining parts will continue to operate where they can do so independently.
